DEBT RECOVERY

The mainstay of the firm, Debt Recovery is what the firm is known for, throughout the United Kingdom. The firm is listed in both Chambers Guide to the Legal Profession and the Legal 500 as a specialist firm in this area.

With access to all 39 Sheriff Courts and to the Court of Session in Edinburgh, the firm can assist with recovery of all size of debt, anywhere in Scotland.

The firm prefers clients to send out their own seven day letters although the firm will send out seven day letters if required. There is no requirement in Scots Law that a solicitor’s letter be sent out before court action, simply that the debtor must be advised that in the event of non payment court action will be raised. Such a letter can be sent out by the client.

Assuming that a warning letter has been sent without success, the firm raises court action as soon as possible thereafter. Clients are kept fully informed throughout the court process. The aim of the process is to secure recovery of the debt, failing which a decree from the court (a decree is a court order for payment).

Once the firm has a court order the various options for enforcement are discussed and instruction taken from the client. Sheriff Officers or Messengers at Arms are then instructed to do the necessary.
